Terms of Use

1. General 
These Terms of Use govern your access to and use of all digital products offered by 
SampleForge, including but not limited to audio samples, loops, sound effects (SFX), 
construction kits, and musical compositions ("Products") available via our website, Shopify 
store, or third-party platforms such as AudioJungle and Pond5. 
By purchasing, downloading, or using any SampleForge product, you agree to these Terms. 


2. Licensing 
All SampleForge products are delivered under a non-exclusive, royalty-free license for 
independent and small-scale commercial use, unless otherwise specified. 
You are permitted to:

  •  - Use the sounds in your own music productions, videos, games, apps, or other multimedia projects (both commercial and non-commercial).
  •  - Edit, remix, and incorporate the sounds into your own original works.

You are not permitted to:

  •  - Resell, redistribute, or upload the sounds as standalone files (original or slightly modified), or as part of competing sample packs, plugins, or libraries.
  • - Use the sounds in NFTs, AI training datasets, or other generative systems without prior written consent.
  •  - Misrepresent SampleForge or the origin of the content.

 
3. Melody Clearance & Royalties 
If any SampleForge melody, loop, or composition is used in a commercially released song under a major label, film, TV production, advertising campaign, or other significant placement, you are required to contact SampleForge for clearance. 
SampleForge reserves the right to negotiate a fair publishing and/or writer royalty share. A typical arrangement includes 25% to 50% of the publishing/writer share depending on the scope of the use.

4. Ownership & Copyright 
All rights, title, and interest in and to the Products remain the property of SampleForge. You are granted a license to use the content, not ownership of it.

 
5. Refund Policy 
Due to the digital nature of our products, all sales are final. We do not offer refunds or 
exchanges once a download has been completed. If you experience technical issues, please contact us at [sampleforge.fm@gmail.com].

 
6. Limitation of Liability 
All products are provided "as-is." SampleForge shall not be held liable for any direct or indirect damages, data loss, device malfunction, or financial loss resulting from the use of our content. 


7. Updates to Terms                                                                                              SampleForge reserves the right to update or modify these Terms of Use at any time. The most current version will always be available on our website.

 
8. Governing Law 
These Terms are governed by the laws of the Federal Republic of Germany.
